Terms of Service

1. Acceptance of Terms

By accessing or using Learn Bislama (“the Platform”), operated by Pacific Wave Digital Ltd, you agree to be bound by these Terms of Service. If you do not agree, please do not use the Platform.

2. Account Registration

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

3. Use of Services

The Platform provides language learning resources including:

• Video and audio courses with AI-powered tutors
• AI conversation practice partners
• Dictionary and vocabulary resources
• Live instructor sessions
• Book store and downloadable resources

You agree not to misuse, copy, redistribute, or reverse-engineer any content or AI features on the Platform.

4. Payments & Platform Transactions

All transactions must occur through the Learn Bislama Platform. This includes:

• Course purchases
• Live session bookings
• Service orders (translations, tutoring, etc.)
• Any other paid interactions between students and instructors

A 20% platform fee is applied to all instructor services and live sessions. This fee covers payment processing, platform maintenance, dispute resolution, and customer support.

Off-Platform Transactions: Any arrangements made outside the Platform (direct payments via bank transfer, mobile money, cash, etc.) are strictly prohibited and done entirely at your own risk. Learn Bislama:

• Cannot mediate disputes for off-platform transactions
• Cannot guarantee service delivery or quality
• Cannot process refunds or chargebacks
• Will not be liable for any losses incurred

Students and instructors who repeatedly engage in off-platform transactions may have their accounts suspended or terminated.

Refund requests for platform transactions may be made within 14 days of purchase for unused services or subscription periods.

5. Instructor Terms

Instructors who create courses retain ownership of their content but grant Learn Bislama a license to distribute it on the Platform.

Instructor Payment Terms:

• Instructors receive 80% of all service and session fees
• 20% is retained by Learn Bislama as a platform fee
• Payments are made to instructors after service completion
• Instructors must complete services within agreed delivery times

Instructors agree not to solicit students for off-platform payments. Violation of this policy may result in account termination and forfeiture of pending payouts.

6. Intellectual Property

All Platform content, design, logos, and AI models are the intellectual property of Pacific Wave Digital Ltd or its licensors. Course content created by instructors remains their property.

7. AI-Generated Content

Our AI tutors provide language practice and should not be relied upon as the sole source of language instruction. While we strive for accuracy, AI responses may occasionally contain errors.

8. Limitation of Liability

The Platform is provided “as is” without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from use of the Platform.

9. Termination

We may suspend or terminate your account for violations of these Terms. You may delete your account at any time through your account settings.

10. Governing Law

These Terms are governed by the laws of the Republic of Vanuatu. Any disputes shall be resolved in the courts of Port Vila, Vanuatu.
